By accessing and using Scoutbasketball ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. These terms apply to all visitors, users, and subscribers of the Service.

Scoutbasketball is a basketball scouting platform that provides access to player profiles, statistics, game reports, and other basketball-related content. The Service is offered through the following subscription tiers:

To access certain features of the Service, you must create an account. You agree to:

• Be at least 16 years of age to create an account
• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent or illegal purposes.

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited activities include, but are not limited to:

• Using automated systems, bots, or scripts to scrape, crawl, or extract data from the Service
• Attempting to gain unauthorized access to any part of the Service or other users' accounts
• Interfering with or disrupting the Service or servers connected to the Service
• Using the Service to transmit viruses, malware, or other harmful code
• Engaging in any activity that violates applicable laws or regulations
• Sharing your account credentials with third parties
• Using the Service for any commercial purpose without authorization

Subscriptions are billed on an annual basis. By subscribing, you agree to:

• Pay the applicable subscription fees for your chosen tier
• Automatic renewal of your subscription at the end of each billing cycle
• Price changes with 30 days notice before the next billing date

You may cancel your subscription at any time. Your access will continue until the end of your current billing period, but no refund will be provided for the unused portion.

All payments are processed securely through Stripe. By making a payment, you agree to:

• Provide accurate payment information
• Pay all applicable taxes based on your location
• Accept charges in EUR or USD as displayed at checkout

What the Pro Profile is

The Pro Profile is an optional, paid add-on that lets an account holder enhance a single player's public profile with self-reported content — such as a written pitch, agent or representative contact details, photographs, highlight videos, and combine measurements — displayed alongside Scoutbasketball's independently verified data. Pro Profile content submitted by users is clearly labelled as "Added by player" and is visually separated from verified Scoutbasketball data.

No guarantee of results

The Pro Profile is a visibility and presentation tool only. Scoutbasketball does not guarantee any specific outcome, including — but not limited to — increased profile views, recruitment interest, scholarship offers, professional contracts, media coverage, or ranking changes. You acknowledge that the value you derive from the Pro Profile depends on many factors outside Scoutbasketball's control.

Availability and "first to pay wins"

Only one Pro Profile may be active for a given player at any time. More than one account holder may prepare a draft for the same player, but activation is granted to the first account whose payment is confirmed. If your payment is confirmed after another user has already activated a Pro Profile for that player:

• Your Pro Profile will not be activated.
• Your subscription is canceled immediately.
• You receive a full automatic refund of the amount paid, using the same payment method, and an email confirming the refund.

Activation timing

A Pro Profile is activated only after the payment is confirmed through our payment provider's asynchronous notification. This typically happens within a few minutes of completing checkout, but may occasionally take longer. Building a draft does not require payment, and no content is published until (a) the Pro Profile is activated and (b) each submitted item is approved by our moderation team.

Your content licence

By uploading or submitting any content to your Pro Profile (text, images, videos, documents, or measurements), you grant Scoutbasketball a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, display, distribute, and adapt that content solely for the purpose of operating, promoting, and improving the Service.

Your representations and warranties

By submitting Pro Profile content, you represent and warrant that:

• You are the player, the player's legal guardian, or an authorised agent or representative acting with the player's (or their guardian's) consent.
• You hold all necessary rights to the content you upload, and the content does not infringe the intellectual property, privacy, publicity, or any other rights of any third party.
• The content is accurate, lawful, and not misleading, defamatory, or otherwise prohibited under these Terms.
• If the player is under 14 years of age, you have obtained the consent of a parent or legal guardian, as required by applicable law.

Moderation

All Pro Profile content is reviewed by our moderation team before it appears publicly. Scoutbasketball reserves the right to approve, reject, edit, or remove any submitted content at its sole discretion, at any time, without prior notice and without refund. Submitting content that violates these Terms may result in termination of your Pro Profile and account under section 10 (Termination).

To verify your authority to publish a player's content — particularly where the player may be a minor or where there are signs of unauthorised use — Scoutbasketball may, at its discretion, request reasonable documentation (such as proof of identity, parental or guardian consent, or authorisation from the player or their representative). Publishing remains suspended until such documentation is provided and accepted. Failure to provide requested documentation may result in rejection or removal of the content without refund.

Prohibited content

You must not upload or submit any Pro Profile content that:

• Infringes the intellectual property, privacy, publicity, or other rights of any third party;
• Is false, misleading, defamatory, harassing, hateful, or discriminatory;
• Depicts or relates to a person under 14 without the consent of a parent or legal guardian;
• Contains personal data of third parties without their consent;
• Is illegal, obscene, harmful to minors, or promotes illegal activity;
• Contains malware, viruses, or any harmful code; or
• Impersonates another person or misrepresents your relationship with the player.

Reporting illegal or infringing content (DSA & DMCA)

If you believe that any content on the Service is illegal or infringes your rights, you may notify us by email at contact@scoutbasketball.com. To help us act quickly, please include:

• The exact URL or description of the content you consider illegal or infringing;
• A clear explanation of why you believe the content is illegal or infringes your rights;
• Your name, email address, and (for copyright claims) a statement that you are the rights holder or authorised to act on their behalf;
• A good-faith statement that the information in your notice is accurate and, under penalty of perjury, that you are authorised to make the complaint.

We review valid notices and act on them without undue delay, generally within 48 hours. Scoutbasketball is established in Spain and, as an intermediary service provider, applies the notice-and-action mechanism required by the Digital Services Act (Regulation (EU) 2022/2065, Article 16).

Counter-notice

If your content was removed because of a notice and you believe the removal was mistaken (for example, because you hold the rights or the use is lawful, such as fair use), you may submit a counter-notice by email to contact@scoutbasketball.com explaining why the content should be restored. We will review counter-notices and, where appropriate, restore the content within a reasonable period, in accordance with applicable law.

Repeat infringers

Accounts whose holders repeatedly submit infringing or prohibited content may be suspended or terminated, and any associated Pro Profile removed, without refund.

Non-transferability

A Pro Profile is tied to a single player and a single account holder. It cannot be transferred to another player, another account, or another user. Subscriptions are personal and non-assignable.

Either party may terminate the service agreement under the following conditions:

Termination by User

You may cancel your subscription at any time through your account settings or by contacting us. Your access will continue until the end of your current billing period. No refund will be provided for the unused portion of your subscription.

Termination by Scoutbasketball

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms of Service, fraudulent activity, or illegal use. Upon termination, you will lose access to all content and features. No refund will be provided.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• The information provided through the Service is accurate, complete, or reliable
• Any errors will be corrected

To the fullest extent permitted by law, Scoutbasketball shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use or inability to use the Service.

We are committed to protecting your personal data. For information about how we collect, use, and protect your data, please refer to our Privacy Policy and Cookie Policy. By using the Service, you consent to the collection and use of your data as described in our policies.

The Service may contain links to third-party websites or services that are not owned or controlled by Scoutbasketball. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Scoutbasketball shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of any such content, goods, or services available on or through any such websites or services.

We reserve the right to modify these Terms of Service at any time. Any changes will be posted on this page with an updated revision date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms of Service. We encourage you to review these terms periodically.

If any provision of these Terms of Service is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

These Terms of Service shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Courts of Alicante, Spain.
